Welcome to the Classical Archives!

The Terms and Conditions that follow set forth the basic rights and obligations regarding your use of, or subscription to, the Classical Archives. Your use of, or subscription to, the Classical Archives constitutes your agreement with these Terms and Conditions. You cannot use the site (or one of its mirrors) or become a subscriber unless you agree to these terms. Please read them carefully.

From time to time, these Terms and Conditions may be revised or modified. By using this site or becoming a subscriber, you also agree to check this page periodically to make sure you continue to agree with the Terms and Conditions, as amended. The Classical Archives shall not notify you of such changes other than by posting them on this page. It is your responsibility to check for your continued agreement. If you are, at any time, in disagreement with any of the Terms and Conditions, you may stop using the site, unsubscribe or not re-subscribe upon termination of a prior subscription. If you do not agree with these Terms and Conditions now, your only remedy is to not subscribe and to leave the site.

  1. Subscription Terms and Classes. The Classical Archives currently provides for the following classes of users and subscriber with rights of usage as indicated:

    • Free Users:
      No charge. Free user must register by providing one valid email address. Listen up to 5 files/day. No HiFi MP3 files can be downloaded. Other material may also be restricted to paying subscribers only. Each physical user is limited to ONE single registration. Do not register several times using several different email address: this would constitute a violation of these Terms and Conditions.

    • Individual Subscriptions:
      $25 per year fee. Access up to 1,000 files/month (limited to 100/day) including HiFi MP3 files, Zip Collections and concert tickets. All files are to be used for the personal enjoyment of the subscriber and his or her family and are not to be shared or distributed in any way.

    • Schools and Libraries:
      $750 per year fee. Students and faculty may each access up to 1,000 files/month/pc within their declared IP-range, and 500 files/month/pc outside that range. There is however a limit of 100/day/pc from any location. All files are for the personal and academic use of the institution's students and faculty and are not to be shared or distributed in any other way.

    Payments up to $500 are to be made by credit card or mailed-in payments (check, cash, money orders) — always in US Dollars. Payments above $500 are to be made by mailed-in bank checks or money orders, only in US Dollars. All payments sent by mail should be addressed to our address as shown in the subscription page. While you may cancel your subscription at any time, no refunds will be made once payment has been made except in case of proven erroneous duplicate payment.

    While billing methods and subscription prices may be changed at any time without prior notice, you are guaranteed your subscription for the current subscription year (365 days from the date of subscription) at the price you paid. At the conclusion of that year, you must pay the then current price to maintain your subscription.

    Subscribers who join via a Gift Membership are also bound to these Terms and Conditions.

    The Classical Archives reserves the unconditional right to accept or reject any application or subscription. If we cancel your subscription for reasons other than violation of these Terms and Conditions, you will receive a pro-rated refund of your paid subscription.

  2. Passwords. As the subscriber, you are responsible for all uses under your account. You agree not to share your password with anyone else other than members of your immediate family (parents and children). In the case of School and Library subscriptions, the password may only be shared with teachers and students in that school or library. In no case may a password be posted on the Internet even if the site is secure. However, in the case of schools and libraries, the password may be sent by email to their authorized users.

  3. NO WARRANTY. THE CLASSICAL ARCHIVES MAKES NO WARRANTY - EXPRESS OR IMPLIED - THAT THE SERVICE WILL BE ADEQUATE FOR USERS’ OR SUBSCRIBERS’ REQUIREMENTS; THAT THE SERVICE WILL BE UNINTERUPTED OR FREE FROM ERRORS; OR THAT CERTAIN LEVELS OF QUALITY ARE MAINTAINED. CLASSICAL ARCHIVES MAKES NO WARRANTY THAT THE SERVICE WILL NOT INJURE YOUR COMPUTER OR SOFTWARE. YOU AGREE THAT YOUR USE OF THE CLASSICAL ARCHIVES IS SOLELY AT YOUR OWN RISK.

  4. Personal Use Only. Files may be downloaded for private use only and may not be used for any commercial purpose. Except as specified in http://www.classicalarchives.com/copy.html, the contents cannot be used in any other website, posted anywhere, or duplicated.

  5. Downloading Restrictions. The use of robots, download accelerators, or similar software is not allowed on our sites except for the well-behaved spiders used by the established search engines. The restrictions for downloading files can be found at http://www.classicalarchives.com/copy.html All users and subscribers are subject to these restrictions, which may also be changed at any time without advance notice. Contributors may provide additional rights or limitations with regards to their respective files - at their sole discretion.

  6. No Deep-Linking. While you are encouraged to provide links to the home page of our Website, www.classicalarchives.com, you must not, under any circumstances, provide links to our media in any website or email. Deep linking to our media (which involves by-passing our controlling scripts or hacking our defenses or that of our partners) is cause for immediate termination of your subscription (if any) and permanent denial of access to our servers. Additionally, if the circumstances so warrant, the matter will be turned over to appropriate authorities for civil or criminal prosecution.

  7. Privacy. It is very important that you read and understand the Classical Archives Privacy Policy. This policy can be found at http://www.classicalarchives.com/privacy.html and applies to your usage and subscription, and is for your benefit. This policy is subject to change at any time without notice.

  8. Relationships with Our Partners. In the event that you choose to utilize the services or goods of one of our advertisers, partners, or linked sites, The Classical Archives will not be held responsible in the event of any dispute or issue that may arise between you and one of these parties.

  9. Intellectual Property. You recognize our trademarks as including the Classical Archives, the Classical Music Archives, Music For The Rest Of Us, and our logo. You acknowledge that our websites contain material protected by US and foreign trademarks and copyrights. You agree not to engage in any conduct that violates or infringes those intellectual property rights. You further agree that engaging in any activity with the aim of circumventing the site's protection and methods is a copyright violation punishable to the full extent of the law. You also agree to notify us immediately should you have any information with regards to any rights issues of any of our contents so that we may investigate it promptly and take necessary action.

  10. Website Changes and Modifications. The Classical Archives maintains the right to add, delete, modify or change the files, links, and contents of its websites. These alterations may be made at any time without advance notice.

  11. Bug Reports. The Classical Archives will send a free subscription certificate to anyone who sends feedback describing a new and reproducible programming bug (error) affecting the site. The determination that a problem is due to a new and reproducible bug is at the sole discretion of the Classical Archives.
